1. Introduction and Agreement
a. These Terms and Conditions apply to all quotes, orders, sales, 3D printing services, manufacturing services, CAD and 3D design services, product design and modification services, finishing services, branding services, website use, communications and other services supplied by AM 3D Solutions trading as AM 3D Solutions (“AM 3D Solutions”, “we”, “us” or “our”).

b. By requesting a quote, submitting a design or file, placing an order, making payment, accepting delivery, using our website or otherwise using our services, you agree to be bound by these Terms and Conditions.
c. If you place an order on behalf of a company, organisation or another person, you confirm that you have authority to bind that company, organisation or person to these Terms and Conditions.
d. These Terms and Conditions apply unless we expressly agree otherwise in writing. Any purchase order, email, document, note or instruction that attempts to add to, change or override these Terms and Conditions will not apply unless accepted by us in writing.
e. We may update these Terms and Conditions from time to time. The version applicable to an order will generally be the version in effect when the order is accepted, unless otherwise required by law.
2. Our Services
a. AM 3D Solutions provides 3D printing, additive manufacturing, custom product manufacturing, CAD and 3D design, prototyping, product modifications, branding products, finishing and related services.
b. Our services may be based on:
- designs created by AM 3D Solutions;
- customer-supplied designs or files;
- customer-approved designs;
- drawings, measurements or specifications supplied by the customer; or
- a combination of the above.
c. Unless expressly agreed otherwise in writing, our manufacturing services are provided according to the design, file, specifications and requirements supplied or approved by you, subject to the normal capabilities and limitations of the selected manufacturing process, material, equipment and technology.
d. Unless expressly agreed in writing, our services do not include engineering certification, structural analysis, safety certification, regulatory approval, compliance testing, product certification, load testing or fitness-for-purpose assessment.
e. Any comments we provide regarding printability, material selection, print orientation, tolerances, wall thickness, strength, surface finish, assembly or design are general manufacturing observations only. They do not constitute professional engineering advice, certification, safety advice or confirmation that a product is suitable for a particular application.
f. Where AM 3D Solutions provides CAD design, product design, file repair, modification or other design assistance, the work is limited to the scope agreed with you. Unless expressly agreed otherwise, such services do not include engineering certification, safety assessment, regulatory compliance assessment, intellectual property clearance, load analysis or fitness-for-purpose validation.
3. Customer-Supplied Files, Designs and Specifications
a. You are responsible for ensuring that all files, 3D models, CAD files, STL files, STEP files, drawings, sketches, dimensions, measurements, instructions and specifications you provide or approve are accurate, complete, lawful and suitable for their intended purpose.
b. Before approving an order, you are responsible for checking all relevant requirements, including:
- dimensions and scale;
- geometry;
- quantity;
- material;
- colour;
- finish;
- infill;
- layer height;
- wall thickness;
- tolerances;
- clearances;
- holes;
- threaded features;
- snap-fits;
- inserts;
- mating components;
- assembly requirements; and
- any other functional or cosmetic requirements.
c. You are responsible for determining whether your design is suitable for the selected manufacturing process and material, including its suitability for any relevant:
- load;
- heat;
- UV exposure;
- chemicals;
- moisture;
- impact;
- fatigue;
- wear;
- dimensional stability;
- creep;
- electrical application;
- food-contact application;
- medical application; or
- other environmental or performance requirement.
d. AM 3D Solutions is not responsible for defects, weaknesses, missing features, incorrect dimensions, incorrect scale, poor fitment, unsuitable tolerances, insufficient wall thickness, file errors, design flaws, assembly problems or performance issues that originate from a customer-supplied or customer-approved design or specification.
e. If a file is defective, incomplete, ambiguous or unsuitable for manufacture, we may:
- request clarification;
- perform basic file repairs;
- recommend modifications;
- refuse the order;
- cancel the order; or
- proceed based on the information available.
Any basic file repair or adjustment performed by AM 3D Solutions is a best-effort manufacturing service and does not transfer responsibility for the underlying design to AM 3D Solutions.
f. Where we manufacture an item substantially in accordance with your supplied or approved design and specifications, the item will not be considered defective merely because the design, file, material selection or intended application was unsuitable.
4. Customer Approval and Responsibility
a. By placing an order, approving a quote, making payment, submitting a purchase order or otherwise instructing us to proceed, you confirm that you have reviewed and approved the relevant design, dimensions, scale, material, colour, finish, infill, layer height, wall thickness, quantity and other specifications.
b. You acknowledge that AM 3D Solutions will manufacture the item according to the supplied or approved requirements, subject to the normal limitations of 3D printing and the selected manufacturing process.
c. You are responsible for determining whether the finished item is suitable, safe and compliant for its intended use.
d. You are responsible for any testing, fitting, validation, risk assessment, certification or professional assessment required before the item is used, installed, sold, distributed or incorporated into another product, machine, vehicle, structure or system.
e. Where a part is intended to replace, resemble or work with an existing product, machine, vehicle, component or spare part, it is not supplied as an OEM, genuine, authorised, certified or safety-rated replacement unless expressly stated otherwise in writing.
5. No Fitness-for-Purpose Guarantee
a. Unless expressly agreed otherwise in writing, AM 3D Solutions does not warrant that a 3D printed part, prototype, model, fixture, jig, bracket, mount, enclosure, replacement part or other product will be fit for any particular purpose or application.
b. This includes, without limitation, applications involving:
- structural or load-bearing use;
- safety-critical applications;
- automotive use;
- machinery;
- electrical systems;
- medical applications;
- food contact;
- high temperatures;
- high wear;
- outdoor exposure;
- commercial or industrial use; or
- regulated applications.
c. You must undertake any inspection, testing, fitting, validation, certification or professional assessment reasonably required before using or relying upon a product.
d. You acknowledge that 3D printed products may exhibit characteristics including:
- visible layer lines;
- support marks;
- seam lines;
- dimensional variation;
- surface variation;
- colour variation;
- warping;
- internal voids;
- anisotropic strength;
- split lines;
- glue or joining lines; and
- other characteristics inherent to additive manufacturing.
e. For functional, load-bearing, safety-related, high-temperature, high-wear, regulated or mission-critical applications, you should obtain appropriate professional advice, engineering assessment, testing and certification before use.
6. OEM, Genuine and Certified Replacement Parts
a. AM 3D Solutions is an independent 3D printing and design business. Unless expressly stated otherwise in writing, we do not supply OEM parts, genuine replacement parts, certified spare parts, authorised replacement parts or safety-rated components.
b. References to a product name, brand, vehicle, machine, model number, part number or other product identification are used only to identify the design or intended compatibility requested by the customer.
c. Such references do not mean that the product is genuine, authorised, certified, safety-rated or approved by the relevant manufacturer or brand.
d. You are responsible for confirming that any replacement or substitute part is suitable, lawful, safe and compliant for its intended application.
7. Quotes and Ordering
a. You may request a quote or place an order through our website, quote form, email, phone, purchase order or another method accepted by AM 3D Solutions.
b. Submitting an order constitutes an offer to purchase the relevant goods or services. We may accept or decline an order at our discretion.
c. An order is accepted when we:
- issue an order confirmation;
- accept payment;
- issue an invoice;
- confirm acceptance in writing; or
- commence work on the order.
d. You should carefully review all order details before approving an order or making payment. Because our products and services may be custom-made, changes may not be possible once production or design work has commenced.
e. Any requested changes after acceptance are subject to our written approval and may result in:
- additional charges;
- revised lead times;
- a revised quotation;
- additional design fees; or
- cancellation of the order.
f. We may refuse, cancel or stop an order where we reasonably consider that it is:
- technically unsuitable;
- unsafe;
- unlawful;
- likely to infringe third-party rights;
- outside our capabilities;
- commercially unreasonable;
- impossible to manufacture; or
- otherwise inappropriate for us to supply.
Where we cancel an order after receiving payment for reasons not caused by your breach, we will refund amounts paid for the cancelled portion, subject to applicable law.
8. Quotes, Pricing and Payment
a. All prices are in Australian dollars unless otherwise stated.
b. Unless otherwise stated, prices exclude GST, shipping, insurance, customs charges, duties, taxes and other third-party charges.
c. Quotes are valid for the period stated on the quotation. If no validity period is specified, a quote will generally remain valid for 14 days from the date issued, unless withdrawn earlier.
d. Quotes are based on the information, files, quantities, materials, finishes and specifications available at the time of quoting.
e. If any relevant information changes, including the design, quantity, material, finish, shipping requirements or production requirements, AM 3D Solutions may revise the quotation.
f. Unless credit terms have been approved in writing, payment is required before production begins.
g. For approved account customers, payment terms will be those stated on the relevant invoice or otherwise agreed in writing.
h. If an invoice becomes overdue, we may pause production, withhold delivery, suspend further work, cancel an order or suspend account terms until payment is received.
i. Title to goods remains with AM 3D Solutions until all amounts owing for those goods and related services have been paid in full, to the extent permitted by law.
9. Production, Lead Times and Delivery
a. Any production, dispatch or delivery timeframe provided by AM 3D Solutions is an estimate unless expressly guaranteed in writing.
b. Lead times may be affected by:
- design or file issues;
- delays in receiving customer information or approvals;
- material availability;
- machine availability;
- failed prints;
- reprints;
- quality-control requirements;
- supplier delays;
- courier delays;
- public holidays; or
- circumstances outside our reasonable control.
c. Unless specific manufacturing requirements have been agreed in writing, AM 3D Solutions may determine the appropriate manufacturing method, printer, print orientation, support strategy, nesting, batch arrangement and production process.
d. Where an item is too large, unstable, inefficient or otherwise unsuitable to manufacture as one piece, we may recommend splitting it into multiple sections and joining, gluing, pinning or assembling those sections.
e. Where an item is manufactured in multiple sections, visible joins, seams or assembly marks may remain unless additional finishing has been specifically quoted and accepted.
f. Shipping and courier services are provided by third parties. To the maximum extent permitted by law, AM 3D Solutions is not responsible for courier delays, loss, damage or misdelivery.
g. You are responsible for providing an accurate delivery address and contact details. Additional costs resulting from incorrect or incomplete delivery information may be charged to you.
10. Inspection and Acceptance
a. You should inspect goods as soon as reasonably practicable after delivery or collection.
b. If you believe that goods do not substantially correspond with the accepted order, you should notify AM 3D Solutions in writing as soon as possible and, unless a longer period is required by law, within 14 days of delivery or collection.
c. Where possible, your notification should include:
- your order number;
- photographs;
- a description of the issue; and
- any other information reasonably required for us to assess the matter.
d. If you believe an item is defective or does not conform to the order, you should not modify, paint, sand, drill, glue, assemble, install, resell or otherwise alter the item before giving us a reasonable opportunity to inspect or assess it.
e. Use, installation, modification, resale or incorporation of an item may be considered acceptance of the goods, except where inconsistent with rights available to you under the Australian Consumer Law.
f. Where an item has been manufactured substantially in accordance with your supplied or approved design and specifications, AM 3D Solutions is not responsible for failures resulting from design, file, specification or application issues.
11. Returns, Reprints and Refunds
a. Because many of our products and services are custom-made to customer requirements, change-of-mind returns, cancellations or refunds may not be available once an order has been accepted and production or design work has commenced, except where required by law or agreed by us in writing.
b. If AM 3D Solutions determines that goods have not been manufactured substantially in accordance with the accepted order, we may, depending on the circumstances and your rights under the Australian Consumer Law:
- repair the goods;
- reprint the goods;
- replace the goods;
- refund the relevant amount; or
- provide another appropriate remedy.
c. We may request the return of goods before providing a replacement, reprint or refund.
d. We are not required to provide a refund, replacement or reprint for issues caused by:
- customer-supplied files;
- customer-approved designs;
- incorrect measurements;
- incorrect specifications;
- incorrect scale;
- unsuitable materials selected by the customer;
- unsuitable intended use;
- normal characteristics of 3D printing; or
- damage occurring after delivery,
except where required by law.
e. Approved refunds will generally be made to the original payment method unless otherwise agreed.
12. Australian Consumer Law
a. Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded, restricted or modified under the Australian Consumer Law or any other applicable legislation.
b. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to remedies where goods or services fail to comply with applicable consumer guarantees.
c. Where the Australian Consumer Law permits us to limit our liability, our liability may be limited to the remedies permitted by law, including:
For goods:
- replacing the goods;
- supplying equivalent goods;
- repairing the goods;
- paying the cost of replacing or acquiring equivalent goods; or
- paying the cost of having the goods repaired.
For services:
- supplying the services again; or
- paying the cost of having the services supplied again.
d. Nothing in these Terms and Conditions removes or limits any rights you have under the Australian Consumer Law that cannot legally be excluded.
13. Intellectual Property and Customer Authority
a. You retain ownership of intellectual property rights in designs and files that you own and provide to AM 3D Solutions.
b. By submitting any file, design, drawing, image, logo, brand material, product reference, instruction or specification, you confirm that you:
- own the relevant rights; or
- have all necessary licences, permissions and authority to provide the material to us.
c. You warrant that our use of customer-supplied material for quoting, designing, manufacturing and supplying your order will not infringe the intellectual property or other legal rights of a third party.
d. You indemnify AM 3D Solutions against claims, losses, damages, liabilities, costs and expenses arising from an allegation that customer-supplied or customer-approved material infringes a third-party right or breaches applicable law.
e. We may refuse or cancel an order where we reasonably believe it may involve infringement of third-party rights, counterfeit products, unauthorised use of a brand or other unlawful activity.
14. Design Services and Ownership of AM 3D Solutions Designs
a. Where AM 3D Solutions creates a custom design, CAD model, 3D model, drawing or other design work for you, ownership and permitted use of that work will be determined by the scope of the quote or written agreement.
b. Unless expressly agreed otherwise in writing, payment for a physical printed product does not automatically transfer ownership of AM 3D Solutions’ underlying CAD files, design files, models, drawings, templates, processes or design methods.
c. Where ownership or transfer of design files is included in a quotation, the applicable rights will be as stated in that quotation.
d. AM 3D Solutions may retain copies of its design files and project records for business, quality-control, repeat-order and record-keeping purposes, subject to applicable confidentiality obligations.
15. Confidentiality and File Handling
a. AM 3D Solutions will take reasonable steps to keep customer files and confidential project information confidential.
b. We may use customer files, drawings, images, specifications and communications where reasonably necessary to:
- prepare quotations;
- provide design services;
- manufacture products;
- perform quality checks;
- provide customer support;
- maintain business records; and
- fulfil orders.
c. We may provide relevant information or files to employees, contractors, suppliers, manufacturing partners, software providers or couriers where reasonably necessary to provide our services.
d. Unless you request otherwise in writing, we may retain copies of relevant files, order records, production information and communications for record keeping, repeat orders, quality control, legal compliance and customer support.
e. We will not sell your customer-supplied design files as our own products or intentionally disclose confidential design information to unrelated third parties except where reasonably necessary to provide our services, comply with law, enforce our rights or protect safety.
16. Photography, Portfolio and Marketing
a. Unless a project is identified to us in writing as confidential, AM 3D Solutions may photograph or record general images or video of completed products for:
- our portfolio;
- website;
- social media;
- marketing;
- promotional material;
- quality control; or
- internal records.
b. Where reasonably practical, we will avoid including sensitive customer information in marketing material.
c. If your project is commercially sensitive, confidential, unreleased, subject to a confidentiality agreement or otherwise not suitable for public display, you must notify us in writing before production or delivery.
d. We will not knowingly publish confidential design files, technical drawings or sensitive customer information as marketing content without appropriate permission.
17. Prohibited, Restricted and High-Risk Orders
a. AM 3D Solutions may refuse, cancel or stop work on any order that we consider unsafe, unlawful, unethical, high-risk, unsuitable or outside our capabilities.
b. We do not accept orders for:
- firearms or firearm components;
- ammunition;
- weapon components;
- illegal items;
- items intended to cause harm;
- counterfeit products; or
- other items that we reasonably believe may be unlawful or unethical.
c. We may refuse or require additional written acknowledgement for products intended for:
- safety-critical applications;
- load-bearing applications;
- vehicles;
- aircraft;
- medical applications;
- food-contact applications;
- electrical applications;
- pressure applications;
- high-temperature applications;
- child-use applications;
- animal-use applications;
- public-use applications; or
- other regulated or high-risk applications.
d. Acceptance of an order does not constitute approval, certification or confirmation that a product is safe, compliant or suitable for its intended application.
18. Materials, Colours, Finishes and Tolerances
a. 3D printing is subject to normal manufacturing variation. Unless expressly agreed otherwise in writing, variations may occur in:
- dimensions;
- colour;
- surface finish;
- texture;
- gloss;
- layer appearance;
- seam location;
- support marks; and
- other cosmetic characteristics.
b. Published or quoted material properties are general reference information only and may not represent the properties of the final printed item.
c. The characteristics of a finished part can be affected by factors including:
- print orientation;
- geometry;
- layer height;
- wall count;
- infill;
- material condition;
- moisture;
- temperature;
- post-processing; and
- intended use.
d. Unless expressly agreed otherwise in writing, quoted dimensions and tolerances are approximate and are not guaranteed for every feature.
e. Small holes, threads, clips, snap-fits, thin walls, long components, tall components and mating parts may require testing, adjustment and design iteration.
f. Exact colour matching is not guaranteed unless expressly agreed in writing. Colours may vary between material suppliers, batches and manufacturing processes.
g. Characteristics such as layer lines, support marks, underside roughness, elephant foot, minor stringing, seams, split lines, glue lines and minor warping may occur as part of the manufacturing process and are not automatically considered defects.
19. Customer-Supplied Hardware and Components
a. Where an order includes customer-supplied hardware, inserts, fasteners, electronics, samples, components or other items, you are responsible for ensuring those items are suitable, accurate, safe, lawful and provided to us on time.
b. AM 3D Solutions is not responsible for defects, incompatibility, delays, damage or performance issues caused by customer-supplied components, inaccurate samples, incorrect measurements or incomplete information.
c. Where we assemble, glue, fit, insert, press, heat-set or otherwise combine printed components with other parts, that work is limited to the agreed manufacturing scope and does not constitute certification that the resulting assembly is safe or fit for purpose.
20. Privacy and Personal Information
a. We may collect personal information such as your name, business name, address, email address, telephone number, order information and payment-related information for purposes including:
- providing quotations;
- processing orders;
- receiving payments;
- delivering goods;
- customer support;
- record keeping;
- legal compliance; and
- business administration.
b. Where reasonably necessary, we may disclose relevant information to payment providers, couriers, software providers, contractors, suppliers, professional advisers, regulators or other service providers.
c. You are responsible for ensuring that personal information you provide to us is accurate, current and complete.
d. Our handling of personal information is also subject to our Privacy Policy, where applicable.
21. Website and Electronic Communication
a. You are responsible for maintaining the confidentiality of any account or login information used on our website or quotation systems.
b. You must provide accurate, current and complete account, billing, delivery and contact information.
c. Electronic communications may be affected by delays, technical faults, filtering, spam systems, corruption, unauthorised access or other technical issues.
d. You accept the ordinary risks associated with email, online forms, file uploads and other electronic communications.
e. If you believe that a quote, invoice, order confirmation, file upload or other communication contains an error, you should notify us promptly in writing.
22. Limitation of Liability
a. To the maximum extent permitted by law, AM 3D Solutions is not liable for indirect, consequential, special, incidental or economic loss, including loss of:
- profit;
- revenue;
- business opportunity;
- goodwill;
- production time;
- business operations; or
- anticipated savings.
b. To the maximum extent permitted by law, AM 3D Solutions is not responsible for loss, damage, injury, failure or non-compliance arising from:
- customer-supplied or customer-approved designs;
- customer-supplied specifications;
- customer measurements;
- customer-selected materials;
- intended use;
- installation;
- testing;
- validation;
- modification;
- post-processing;
- misuse;
- improper storage;
- improper handling; or
- operation outside the intended or agreed use.
c. To the maximum extent permitted by law, our total aggregate liability relating to an order is limited to the amount paid by you for the specific goods or services giving rise to the claim.
d. Nothing in these Terms and Conditions limits or excludes liability that cannot legally be limited or excluded under the Australian Consumer Law or other applicable legislation.
23. Indemnity
a. To the maximum extent permitted by law, you indemnify AM 3D Solutions, its owners, directors, employees, contractors and agents against claims, losses, damages, liabilities, costs and expenses arising from or connected with:
- your supplied or approved designs;
- your files and specifications;
- your breach of these Terms and Conditions;
- infringement of third-party rights;
- your use, installation, resale or distribution of products;
- modification of products after supply;
- failure to appropriately test or validate products; or
- unlawful, unsafe or improper use of products.
b. This indemnity is reduced to the extent that the relevant loss or claim is caused by our negligence, breach of these Terms and Conditions or breach of a law that cannot legally be excluded.
24. Force Majeure
a. AM 3D Solutions is not responsible for delays or failure to perform caused by circumstances outside our reasonable control.
b. Such circumstances may include:
- equipment or machine failure;
- power outages;
- internet outages;
- fire;
- flood;
- storms;
- pandemics;
- labour shortages;
- supplier delays;
- courier delays;
- material shortages;
- equipment breakdown;
- government action;
- war;
- civil unrest; or
- other events beyond our reasonable control.
c. Where such circumstances occur, we may extend lead times, pause production, source alternative materials, cancel affected orders or take other reasonable steps to manage the situation.
25. Governing Law and Disputes
a. These Terms and Conditions are governed by the laws of Victoria, Australia.
b. The parties submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth courts of Australia.
c. Before commencing formal legal proceedings, the parties should attempt in good faith to resolve a dispute through written notice and reasonable discussion, except where urgent legal relief is required or debt recovery action is necessary.
26. Severability and Entire Agreement
a. If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be severed or limited to the extent necessary and the remaining provisions will continue to apply.
b. These Terms and Conditions, together with the accepted quotation, order confirmation, invoice and any written special terms agreed by AM 3D Solutions, form the agreement between you and AM 3D Solutions for the relevant order.
c. A failure by AM 3D Solutions to enforce any right under these Terms and Conditions does not constitute a waiver of that right.
